General Terms and Conditions

Contracting party for customers and orders alsways is Geral-Media GmbH & Co. KG (see provider character), named "seller" in the following or „Geralmedia“.


§ 1 Coverage

1.1
For all deals with the seller the following terms of conditions are valid only.

Deflecting conditions are only valid if the seller signed them in written form.

1.3
By sending an order (online, by phone or written post) the buyer accepts the following conditions.

The seller is entitled to change or endorse the general terms of conditions by adequate cancellation period. Incoming orders before, are processed according to the elder terms of conditions.


§ 2 Conclusion of Agreements / Variancies

2.1
Orders mean binding offers of the buyer. Acceptance is shown by a written order confirmation by the seller AND delivery with invoice.

2.2
Offers of the seller are always subject to change. Tea is a natural product, therefore smaller changes against drawings and descriptions are possible.


§ 3 Prices / Terms of Payment

3.1
If nothing else is written in the order confirmation or within the prices in the online shop, all prices are including the legal VAT.

3.2
The product prices do not include shipment costs. Shipment costs are calculated addidionally and among shown in the shopping cart.

3.3
The terms of payment are shown during order process. in general the seller may choose between advance payment, cash on delivery and paypal.

3.4
Advance payments are to be arranged within 7 day after order. Afterwards the seller is no longer able to guarantee delivery. So occurring over payments are refunded to the buyer.


§ 4 Delivery / Delay

4.1
In general orders are completed within 1-3 weekdays. For new customer orders we need another 1-2 days. If an article is exceptional not immediately available, the delivery time may extend about up to 3 days. If an article is current out of stock and/or non deliverable at all or the date of delivery can not be fixed by the supplier, the seller reserves the right not to deliver the article. The selling price is refunded or credited on desire.

4.2
The seller reserves the right to partial shipment.

4.3
On delays claims for damages are only possible if the delay happened due to culpable negligence. Claims are restricted to the amount of the order. Further claims are excluded.

4.4
If acceptance is delayed by the customer, without culpable negligence of seller/supplier, the customer has pay compensations.


§ 5 Transfer of Perils

5.1
Perils are transferred to the customer by proper deliverance of the goods by the parcel service. With dealers the transfer of perils obtains from disposal of the goods to the parcel service.


§ 6 Delivery / Damage on Transit

6.1
The delivery needs to be checked against damaged of transport immediatly on arrive and BEFORE signature. If any damages occured on transport this needs to be signed by the parcel service. If it is a damage which could not be seen immediately by normal accuracy it needs to be announced up to 7 days after receipt of the package at the belonging parcel service. Therefore the original package and the complete content needs to be shown, inlcuding the original invoice or delivery note.

6.2
Damaged on transit need to be announced to the seller within 7 day after receipt in written form.


§ 7 Right of Withdrawal

7.1
You may withdrawal your order within two weeks against the seller according to regulations of §3 Fernabsatzgesetz in alliance to §361 a BGB:

Withdrawal is possible only for private buyers without any reasons. it can be announced in written form, via email or by reshipment of the goods. To comply the term the goods or announcement have to be reshipped in due time. Food (tea, cookies, marmelade etc.) are excluded from withdrawal, if the direct packing has been opened, meaning, according to the packing, the weldseam, security seal, cover or similar have been opened. After withdrawal you are bound to reship the complete goods. Up to order amount of 40,00 € reshipment is to be paid by the customer. Please confer the reshipment conditions with us by phone or email. Freight collected mailings are not accepted - After consulting you may advance the reshipment costs or receive a package label from us or we collect the batch. Please refer to Geral-Media GmbH & Co. KG, - Retourenabteilung -, Alte Maate 5, 48529 Nordhorn, for reshipments

7.3
The reshiped goods need to be in efficient condition and in the original packing. If goods or packing is not efficient, sellable condition, the seller is allowed to claim depreciation or usage charge. If you send the goods by yourself the shipment has to be an insured parcel. We do not overtake liabilities for reshipment damages on transit for shipments initiated by the customer. In case of failings we have the right for remedies.


§ 8 Reservation of Title

8.1
Up to complete payment the goods remain properties of the seller.


§ 9 Storage of Data

9.1
According to §28 of Federal Data Protection Act the seller points out, that personal data is stored and processed via EDP for for transactional purposes. Personal is examined confidential and not transfered to a third party

§ 10 Disclaimer for external links

This website contains links to websites of a third party ("external links"). These websites are subject to the liabilities of the belonging operator. All links have been checked once at first usage against possible right offenses. At this point no offenses have been obvious. The provider does not have any influence on the actual or future design and content of the linked sites. The setting of these links does not mean, that the provider adopted the contents of the link. A regular control of the links is without hint to concrete offenses reasonable for the provider. On knowledge of offenses the links will be deleted immediately.

§ 11 Jurisdiction / Severability Clause

11.1
Jurisdiction for registered traders, judical personsof public law and orders from foreign countries is 48529 Nordhorn or the nearest court of a higher authority.

11.2
If any settlement of these terms of conditions is defined effective in law totally or partial ineffective, a term coming off best to the elder term supercedes. All odd terms remain valid.
